Iraq criticises Kurdistan over oil 'grey area' February 1, 2014 BAGHDAD,— Iraq's top minister responsible for energy affairs on Saturday criticised the autonomous South Kurdistan's push towards exporting oil independently of Baghdad, calling it a grey area lacking in transparency. Iraqi Deputy Prime Minister Hussein al-Shahristani's remarks are the latest salvo in a long-running row between the central government and the northern Kurdistan region over energy sales and, by extension, the extent of federalism in Iraq. "The most prominent challenge is that we have not reached a national agreement to extract and market oil from all of Iraq's territory," Shahristani said in a speech in Baghdad at an event looking at the past decade for Iraq's energy industry. "The situation with the South Kurdistan is still stuck. This file is not resolved, in spite of some progress having been made. We hope it will end soon." Shahristani continued: "We have a grey area -- we do not know how much oil the region is extracting, what price they are selling at, and where the revenue goes." Baghdad argues that all oil sales must be overseen by the central government, and regards any independent exports as tantamount to smuggling. US Vice President Joe Biden spoke with Kurdish President Massoud Barzani by telephone Friday to discuss reaching an agreement with the central government on oil sales. "The vice president and President Barzani both confirmed the need for close cooperation between the Kurdistan regional government and the Iraqi government to reach agreement on a way forward on the matter of energy exports and revenue sharing," the White House said. Iraq has threatened to boycott Turkish companies and cancel contracts after the Kurdistan region last month announced its first shipment of crude sent directly to Turkey, without passing through pipelines controlled by Baghdad, had gone on sale, with more expected to follow. Kurdistan, which enjoys a high level of autonomy from Baghdad and has its own security forces, government and flag, has also drawn Baghdad's ire for signing contracts with foreign energy firms without its approval. In addition to disputes over natural resources, the long-standing ambition of Kurdish leaders to incorporate other historically Kurdish-majority areas into their autonomous region, against Baghdad's strong opposition, is another major point of contention. For the past year, the Kurdish Regional Government (KRG) has trucked about 60,000 barrels per day (bpd) of crude to Turkish ports, avoiding the Baghdad-run Iraqi pipeline system as it tries to gain more control over oil revenues. The central government threatened to sue over the shipments in a long-running dispute that talks between Baghdad and Erbil have so far failed to settle, but it took no legal action. However, Baghdad is now preparing to act because it says the Kurds have raised the stakes by building a new pipeline linking their semi-autonomous landlocked region to Turkey. Iraq’s oil ministry instructed legal firm Vinson and Elkins about two months ago to pursue anyone who buys oil pumped down the pipeline to the Turkish city of Ceyhan, near the Mediterranean, a senior Iraqi oil official said. “This is not a game. Anyone who buys this oil is doing something illegal,” said the official, who asked not to be named. “We will target the companies because they are the ones who will monetize and pay for the Kurdish oil. How else can it get onto the market?” Baghdad turned a blind eye to small trading companies that have bought barrels via regular tenders and trucked them across the border. Those tenders are still taking place. But while the trucked amounts are relatively modest, Baghdad realized the Kurds were serious about independent exports when they sent test shipments down the pipeline in early December. “You can’t compare general trucking of 60,000 barrels or less to significant exports through a pipeline system,” the senior Iraqi official said. “We have a bilateral, international agreement with Turkey - ratified by parliament - that does not allow the Iraq-Turkey pipeline to be used by a third party without the consent of the Iraqi government.” The central government insists it has the sole right to export Iraqi resources, including those from the northern Kurdistan region which gained de facto autonomy after U.S.-led forces defeated Saddam Hussein in 1991. The KRG says its right to exploit and export reserves under its soil is enshrined in Iraq’s federal constitution, which was drawn up following the Gulf War of 2003, and has passed its own hydrocarbons legislation. So far the talks between Baghdad and the Kurdish authorities in Erbil have borne little fruit, and once the storage tanks are full, Turkey must decide whether to turn off the taps or export the oil in defiance of Baghdad. Turkish Energy Minister Taner Yildiz said on Jan. 30 that around 220,000 barrels of Kurdish oil has been stored so far in tanks in Ceyhan. It remains unsold, and Iraq’s threat of legal action appears intended to deter would-be buyers. What is a Production Sharing Contract (PSC)? In oil and gas, PSCs are a common type of contract signed between a government and an Exploration and Production (E&P) company to define how much of the production each party will receive. PSCs were first used in Bolivia in the 1950s, however they were relatively uncommon until recent times, and they now dominate oil and gas agreements, especially in the Middle East and Central Asia. Under PSC arrangements, the E&P company bears the financial risk until such time a discovery is made. If a discovery is not made, no cost is recovered by the E&P company. However if a discovery is made and the field begins to produce, the company is permitted to use the money from produced oil to recover capital and operational expenditures, known as "cost oil". The remaining money is known as "profit oil", and is split between the government and the company, typically at a rate of about 80% for the government, 20% for the company. Although in the South Kurdistan, that rate is typically closer to 90% for government. |

Kurdish oil ambitions Kurdistan, the self-governing region of KRG, is poised to realize a gusher in revenue from its oil fields. Estimated reserves of about 45 billion barrels of crude have piqued the interest of several of the world’s largest oil companies. Although getting crude out of the country has until now been a challenge, the opening of a pipeline into Turkey at the start of 2014 will make it significantly easier to get the oil to markets. “We’re looking at multibillion barrels,” says Dougie Youngson, an analyst at VSA Capital in London. “The operators are sitting on huge resources that they want to start commercializing.” Once it gets going, the pipeline, built and owned by the Kurdistan Regional Government, could result in exports of about 400,000 barrels of oil annually, according to the government. The output will jump to 1 million barrels a year by 2015, and 2 million barrels by 2019, says Ashti Hawrami, Kurdistan’s minister of natural resources. Such estimates have prompted ExxonMobil, Total, Chevron, and Gazprom to sign exploration agreements with the government. If it were a country, Kurdistan would rank 10th among the largest oil-holding sovereigns in the world. It produces about 200,000 barrels per day, with 50,000 of that exported to Turkey by truck. Southern Iraq’s oil fields pump out about 3 million barrels per day. KRG oil agreement among Turkey’s current problems 01.02.2014 By Hemin Khoshnaw Several political analysts believe many of the current problems encountered by the Prime Minister of Turkey, Recep Tayyip Erdogan, are due to the export of oil from the South Kurdistan to Cihan Port. Other disagree, however, noting that Turkey has no other option. In recent years, Turkey has undergone significant economic development. The development has in turn increased the demand for oil and natural gas. But unlike before, Turkey can no longer rely on what were its two main sources of energy – Russia and Iran. Russian gas has become more expensive, whereas Iran has been hit hard by sanctions from the international community on its export of energy resources. According to statistics released by the Turkish Ministry of Energy, Turkey needs 650,000 barrels of oil per day to meet demand, and yearly the country requires US$45-46 billion cubic meters of natural gas, of which only 11 percent is consumed in Istanbul. Thus, Turkey’s energy needs have pushed Erdogan to find a reliable source that is able to fulfill its demands. Bayram Bozyel, a Kurdish politician and former vice chair of the Rights and Freedoms Party (HAK-PAR), told BasNews that, “Turkey is obliged to buy oil from the South Kurdistan because sanctions on Iran have not been removed yet and Russian oil is expensive. The best option for Turkey right now is the South Kurdistan, which, at the same time, will boost Kurdistan’s market.” Boyzel noted that Turkey has to talk to the U.S. to try and convince them to get the federal government of Iraq to agree on the oil pipeline from the South Kurdistan to Turkey. Boyzel said this is not only an economic case, but a political and strategic case as well. Regarding the problems currently facing Erdogan over Turkey’s oil agreement with the South Kurdistan, Boyzel stated that, “Not all the problems facing Turkey these days are related to this agreement. Turkey’s relations with the U.S. at the moment are strained because of Syria, Iran and Egypt.” “Turkey is buying weapons from China, and there is some talk about Turkey becoming a member in the Shanghai Cooperation Organization. While Erdogan is making visible moves towards the east, the west has not completely given up on him,” Boyzel explained. According to information obtained by BasNews, the agreement between the South Kurdistan and Turkey has not been signed by the ministries of energy and oil on both sides, but between Kurdistan Regional Government (KRG) Prime Minister Nechirvan Barzani and Turkish Prime Minister Erdogan, which means Erdogan is insisting on this agreement despite the internal and external pressures on him to not go through with it. Mohammed Kaya, head of the Social Investigation Center in Dijla, told BasNews that attempts are being made to distract Erdogan with internal problems and keep him from dealing with external affairs. “Erdogan’s bloc has done many important things since they came to power - the peace process and solving the Kurdish issue being one of them. But there are attempts by some people to pressure him to change the direction of his policy,” Kaya explained. Kaya acknowledged that the issues pertaining to the oil pipeline from Kurdistan through Turkey is not simple because there are many internal and external problems threatening to hinder the process. “Turkey has not solved its problems with Iraq, Syria and Iran yet. In addition to this, Turkey wants to run from any problems that could emerge between Turkey and the U.S. Therefore, they must negotiate with the KRG, the federal government of Iraq and the U.S.,” Boyzel noted. Prof. Wahab Joshkon, a Dijla University lecturer in Turkey, noted that both the federal governments of Iraq and the U.S. are concerned about Turkey’s oil and natural gas agreement with the KRG. “It is not going to be easy for Turkey to give up this agreement with the KRG.
